IR Update

The Fair Work Commission has proposed for 103 Modern Awards to be varied with the inclusion of new provisions designed to alleviate challenging business conditions currently facing employers and their workers.

These variations are set to include the following provisions:

Pandemic Leave Allowing employees to access two weeks of unpaid leave if they are required to self-isolate or otherwise can’t work. 

Annual Leave Allowing employees to access their Annual Leave at half pay, enabling them to double the amount of annual leave time at half their pay.

In a recent statement by Federal Minister for Industrial Relations, Christian Porter, the move is said to save tens of thousands of jobs by providing employers with more flexibility. He also indicated these proposed award terms would operate for as long as the pandemic lasts although the Fair Work Commission in a statement issued yesterday indicated 30 June 2020 as potential end date unless an application for extension occurs.

With respect to the hardest hit industries impacting a workforce of approximately 2 million employees are those covered by the Restaurant Industry Award 2010, Clerks – Private Sector Award 2010 and Hospitality Industry (General) Award 2010, which have already been varied to include flexibility for annual leave at half pay.
